To Cross Or Not To Cross...This Is The Answer!...Lenihan Doing Fine After Hip Surgery |

WILL CHAIRMAN LENIHAN DECIDE TO REACH A SUPREME COURT CROSS ENDORSEMENT AGREEMENT WITH GOP CHAIRMAN JIM DOMAGALSKI?...OUR SOURCE CONTENDS HE SHOULDN'T DO IT Should Erie County Democratic Chairman Len Lenihan seek a cross endorsement agreement with GOP numero uno Jim Domagalski by which the two parties would agree to back common slates of two or three Supreme Court contenders, thus taking all the drama out of the Nov. election as far as bench races are concerned? Our source contends that such a move would make no sense in view of Chairman Lenihan committment to backing Democratic County Sheriff candidate John Glascott. "Look," our guy contends, "if Chairman Lenihan supports a dream team Democratic Supreme Court slate of incumbent John O'Donnell, County Court Judge Shirley Troutman, and Buffalo Housing Court Judge Henry Nowak, all of whom he has praised as highly qualified contenders, such a move would serve to bring out the maximum Democratic vote possible. Why? Because you'd have Judge O'Donnell's South Buffallo Irish and other friends and supporters coming out to back him. Then you'd have Judge Troutman's supporters in the African-American community and elsewhere coming out to vote for her. And, you'd have the enormous family name recognition of Henry Nowak plus his natural appeal to the local Polish community also contributing to the potential of a large Democratic vote in November. |

LOCAL HUD OFFICIALS WON'T GO ALONG WITH WHITEWASH OF BRIAN DAVIS INFLUENCED HUD OPERATION...SYAED ALI SUIT ALSO NAMES CITY AS DEFENDANT We are hearing that political muscle is being applied in Washington to quash a HUD report critical of local HUD malfeasance engineered by embattled Elicott District Common Council Member Brian Davis. The fly in the ointment at the moment is that local HUD officials are refusing to have their personal integrity compromised by going along...That information technololgy executive Syaed Ali NYS Supreme Court law suit charging a Bufalo Police Officer and an Attorney General's Office investigator with "violation of constitutional rights" now, as we predicted, does include the City of Buffalo as a defendant. The attorney representing the local businessman will be respected constitutional lawyer David Jay. Among those lending their support to the Glascott for Sheriff campaign at Monday night's kick-off fundraiser were: Lackawanna Democratic Chairman Fran Warthling, Buffalo Housing Court Judge and Supreme Court candidate Henry Nowak, NYS Assemblymember Dennis Gabryszak, Wales Dem Chairperson Mary Julian, former Cheektowaga Town Board Member Bill Rogowski Sr., Cheektkowaga activist Andy Kulyk, and Erie County Democratic Party Executive Director Jeremy Zellner representing Chairman Len Lenihan who is currently recovering from hip surgery. Finally, this...Why has former AFL-CIO President John Kaczorowski now registered as a Republican, with the change to take effect in January, even though he is currently running in the Democratic Primary for re-election? While Cheektowaga Dem Chairman Max is publicly dedicating himself to "downsizing the Republican Party," inquiring minds want to know why Kaczorowski is attempting to add to its dwindling ranks. |

NEWWNYPOLITICS REGRETS PUBLISHING INCORRECT REPORT RELATED TO CHAIRMAN MAX IN HEAT OF COUNTY CHAIRMANSHIP BATTLE Last year during the height of the battle for the Erie County Democratic Chairmanship between incumbent Len Lenihan and Cheektowaga Chairman Frank Max, we published one or more reports related to the background of Chairman Max that were based on information furnished to us from usually reliable sources, not connected to Chairman Lenihan. Now we realize that those reports were incorrect, apparently due to the fact that these sources were being influenced by the heat and passion connected to that fight. In any case, we want to apologize to Cheektowaga Chairman Frank Max and to his family for any pain they might have experienced due to the publishing of these inaccurate stories. We regret the error. |

GLASCOTT SKILLFULLY CONTENDS "WE WON'T DWELL ON" PHILLIPS, OTHER ESCAPES, DEATHS, LAWSUITS...CROWD GETS MESSAGE...LENIHAN, MAX UNITED BEHIND GOAL OF ELECTING CHEEKTOWAGA POLICE CAPTAIN A crowd of over 700 gathered at the Hearthstone on Dick Rd. on Monday night to pay $35 each or more to kick off the campaign for Erie County Sheriff of Cheektowaga Police Captain John Glascott. A product of the amazing crowd gathering ability of Cheektowaga Democratic Chairman Frank Max, the event brought together Max's formidable talents with the political muscle of Erie County Democratic Chairman Len Lenihan, aided by the stellar reputation of Captain Glascott in his home town. "Look at this crowd for an event that was put together in only two weeks," said one observer. "And, all this for someone some have said 'has no name recognition!...According to who?" When it came time for Glascott to speak, he seized the opportunity like a veteran campaigner though he has never run for office before. |

Syaed Ali Suit To Be Filed This Week...Two Officers Listed As Defendants |

Written by Glenn Gramigna, Editor

NYS SUPREME COURT SUIT TO BE FILED BY PROMINENT WNY CONSTITUTIONAL LAWYER Highly reliable sources are telling NewWNYPolitics that WNY information technology entrepreneur Syaed Ali will file suit in NYS Supreme Court this week seeking redress for seizure of his personal property and "violation of his constitutional rights" in connection with the Nov. 7, 2008 police raid on his family home at 578 Breckenridge Ave. The defendants named are a Buffalo Police Officer and an investigator with the Buffalo Office of NYS Attorney-General Andrew Cuomo. In the suit, both are accused of participating in illegally detaining Ali for over seven hours without benefit of an arrest warrant and without granting him his Miranda or other rights under the Constitution of the United States. Ali has publicly accused the officers of asking him questions about his political associations during the time he was detained. The suit is being filed on behalf of Ali by a prominent local constitutional attorney, not by Ali's original counsel in connection with the case, according to our source. Though the two initial defendants named are individuals, the case is expected to eventually lead to the citing of the City of Buffalo and the State of New York as the actual objects of the suit. Though the raid was conducted almost eight months ago, no charges have been field against Ali nor has his property been returned. |

NEWWNYPOLITICS UNCOVERS TWO OTHER "ONE SUNSETS" FAVORED WITH EXCESSIVE BERC CASH THANKS TO DAVIS Alll those investigators, both journalistic and public, must have fallen in love with the spacious ambience of Gates Circle, according to a highly reliable source. "How else can you explain their exclusive fascination with all the economic development money lavished on that area's former "One Sunset" restaurant and bar," our guys asks, "when the truth is that the Brian Davis influenced Buffalo Economic Renaissance Corp. actually piled its excessive generosity to the tune of tens of thousands of bucks on two other totally unworthy restaurant/tavern projects, owned and controlled by politically well connected proprietors. There was one watering hole located downtown which is a favorite of the local legal eagle community which got a ton of dough, much more than any sane investor would put into it..." And another place to which our source has made no reference up to now. |

No Constitutional Remedy For Albany Mess...Gov. Can't Withhold Pay...Maziarz Changes Tune |

LACK OF LT. GOV. MEANS THERE IS NO CONSTITUTIONAL REMEDY TO STATE SENATE CRISIS...BEYOND FORCING SENATORS TO COME TO SPECIAL SESSION, BALANCE OF POWERS MEANS PATERSON CAN'T PUNISH SENATORS...MAZIARZ CHANGES TUNE ON NO PAY FOR NO SHOWS Anyone expecting some judge to resolve the current NYS Senate leadership crisis should give up the ghost. A highly informed source abetted by known constitutional expertise is telling us that there is simply no constitutional remedy for this crisis in the absence of having a Lt. Governor in place. "Originally, there were 62 members of the NYS Senate, one for each county in the state," our expert explains. "Up until the one man, one vote federal Supreme Court ruling of the early 60s, every Senator represented an entire county, no matter its size. In any case, since we have an even number of state senators, the only person who can break a tie if everyone votes is the Lt. Governor, who also holds the ceremonial title of President of the Senate. Since the Spitzer resignation means that we have no Lt. Gov., we have no one to break the tie, nor can any other elected official impose his will on the Senate because that would violate the separation of powers doctrine under the US and NYS Constitutions...So the upshot of it all is that the 62 Senators are going to have to resolve this issue themselves. There is no other constitutional remedy." Can Gov. Paterson withhold the pay of Senators who won't do what he says or wants?" |

Syaed Seeking Tougher Counsel...Federal Lawsuit |

WNY INFORMATION TECH ENTREPRENEUR TO PURSUE FEDERAL LAWSUIT OVER PROPERTY SEIZURE, FALSE ARREST On Nov. 7, 2008 Buffalo Police Officers along with representatives of the NYS Attorney General raided the Breckinridge St. family home of information technology entrepreneur Syaed Ali and seized thousands of dollars of his and his parents' possession pursuant to a search warrant that gave law enforcement the right to grab materials related to "the distribution of FALSE PRESS RELEASES." According to informed sources, the officers on the scene then detained Syaed for over seven hours without benefit of an arrest warrant and also without giving him the benefit of counsel, food, sanitary facilities, or communicatin with his loved ones. During the interrogation, Syaed has reported that officers asked him questions about his political associations in an attempt to implicate certain political figures in wrongdoing. In the almost eight months since, Buffalo Police have kept almost all of the Ali family's possessions though no charges have been filed and there is no evidence that any investigation is ongoing. Now highly dependable sources are telling NewWNYPolitics that this 25 year old businessman has had enough. Reportedly, he has switched to much more aggressive legal representation and has tentatively decided to pursue a federal lawsuit, not only in an attempt to retrieve his and his family's property but also to seek redress for the violation of his civil rights under the United States Constitution. If the suit goes forward, and there is no reason to think it won't, it could lead to genuine fireworks as the relevant officials are forced to testify about the case under oath. |

NIAGARA COUNTY DEM CHAIRMAN RIVERA CALLS DINAPOLI "DEDICATED TO HELPING WNY...AN EXCELLENT PUBLIC SERVANT" Wednesday night's Niagara County Democratic fundraiser in honor of NYS Comptroller Tom DiNapoli was a big success as 50 guests enjoyed both a beautiful setting and the opportunity to personally interact with the Comptroller. Set amidst the splendor of Niagara Falls' historic Red Coach Inn as the rapids swirled in the background, the event attracted a wide variety of distinguished attendees from the legal, business, and accounting professions as well as from the world of politics, with NC Democratic Chairman Dan Rivera presiding over the festivities. Among those attending was NYS Supreme Court Justice John O'Donnell, Buffalo Housing Court Judge and Supreme Court candidate Henry Nowak, Niagara Falls Mayor Paul Dyster, North Tonawanda Mayor Larry Soos, former Assembly Majority Leader Paul Tokasz, UAW NYS Political Action Committee Director Sam Williams, NFTA Commissioner Adam Perry, Buffalo Parking Authority Board Member Aaron Segal, and Village of Wilson Mayor Pat Callahan, the first Democrat to win this post in 150 years. "It was a great event which was made even more enjoyable by the fact that Comptroller DiNapoli was very receptive to everyone who was present and made himself available to talk and take pictures with all who attended," Chairman Rivera reported. " The Comptroller scored a big hit with everyone." |

Thompson: Dems For Power Sharing...Why Not The GOP? |

THOMPSON PUSHES BI-PARTISAN AGREEMENT INCLUDING BI-PARTISAN COMMITTEE TO DECIDE WHAT BILLS ARE CONSIDERED As Day 17 dawned of the NYS Senate leadership crisis dawned this morning, most observers weren't predicting much change in the situation and they were right. As it turned out, Governor Paterson's summons to the Legislature turned out to be defective, with the result that little or nothing was done. "The Governor tried to call us back into session, but it wasn't legal because he didn't summon both houses at the same time and to consider the same bills," Buffalo/Niagara Falls Senator Antoine Thompson reports. "For the second straight day, it was the 31 Democratic Senators who ran the Senate under President Pro Tempore Malcolm Smith. The Republicans didn't show up." What will happen next?...Senator Thompson believes what should happen is that the Republican/Espada coalition should agree to the Democrats' proposed power sharing agreement. |
